By accessing and using TeachSmart's AI-powered educational platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service are governed by Hong Kong law and subject to the jurisdiction of Hong Kong courts.
2. Description of Service
TeachSmart provides AI-powered educational tools including but not limited to:
- Automated grading and assessment tools
- Educational content analysis and feedback
- Curriculum planning and lesson optimization
- Student performance analytics
- Educational resource recommendations
3. User Accounts and Responsibilities
Account Registration
- You must provide accurate and complete information
- You are responsible for maintaining account security
- You must be at least 18 years old or have institutional authorization
- One account per user; sharing accounts is prohibited
Acceptable Use
- Use the Service only for legitimate educational purposes
- Comply with all applicable laws and regulations
- Respect intellectual property rights
- Do not attempt to reverse engineer or hack the platform
4. Educational Data and Student Privacy
Special provisions apply to educational data and student information:
- Teachers are responsible for obtaining necessary consents before uploading student work
- Student data must only be used for legitimate educational purposes
- We comply with educational privacy standards and regulations
- Teachers retain ownership and control over their students' data
- Data sharing with third parties requires explicit consent
5. AI Tools and Limitations
AI Accuracy Disclaimer
Our AI tools are designed to assist educators but are not infallible. Users should:
- Review and verify all AI-generated assessments and feedback
- Use professional judgment in educational decisions
- Understand that AI suggestions are recommendations, not requirements
- Report any inaccuracies or concerns to our support team
Prohibited Uses
- Using AI tools to replace human judgment in critical educational decisions
- Submitting inappropriate, harmful, or illegal content
- Attempting to manipulate or bias AI algorithms
- Using the service for non-educational commercial purposes
6. Intellectual Property
Intellectual property rights are distributed as follows:
- TeachSmart retains all rights to the platform, software, and AI algorithms
- Users retain ownership of their original educational content
- Student work remains the property of students and their institutions
- Users grant us limited rights to process content for service provision
- We may use anonymized data for research and platform improvement
7. Payment and Subscription Terms
Billing
- Subscription fees are billed in advance
- All fees are in Hong Kong Dollars unless otherwise specified
- Taxes may apply based on your location
- Payment methods include credit cards and institutional billing
Cancellation and Refunds
- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- Refunds are provided on a case-by-case basis
- Institutional accounts may have different cancellation terms
8. Service Availability and Modifications
We strive to maintain high service availability but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. Scheduled maintenance will be announced in advance when possible.
9. Limitation of Liability
To the maximum extent permitted by Hong Kong law:
- Our liability is limited to the amount paid for the Service in the preceding 12 months
- We are not liable for indirect, consequential, or punitive damages
- Users are responsible for their own educational decisions and outcomes
- We do not warrant that AI tools will be error-free or meet all educational needs
10. Termination
Either party may terminate this agreement:
- Users may terminate by canceling their subscription
- We may terminate for breach of these terms
- We may terminate with 30 days' notice for business reasons
- Upon termination, data will be handled according to our Privacy Policy
11. Dispute Resolution
Any disputes arising from these terms will be resolved through binding arbitration under the Hong Kong International Arbitration Centre (HKIAC) rules. The arbitration will be conducted in English in Hong Kong, and Hong Kong law will apply.
12. Changes to Terms
We may update these Terms of Service from time to time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the new terms.
